What the Law Says

Under Regulation 7 of the Management of Health and Safety at Work Regulations 1999, employers must appoint someone with the necessary skills, knowledge and experience to assist in complying with statutory duties.

If you do not have someone suitable in house, you can appoint an external consultant like Pragmatic Safety.

Can the competent person be someone already in my company?
Yes, if they have the right skills, knowledge and experience. In practice, most small and medium businesses don't have someone with the time or specialist background to cover this properly, which is when appointing an external competent person makes sense.

What happens if I don't appoint one?
You're not meeting your legal duty under Regulation 7. If something goes wrong, an accident, an HSE visit, an enforcement notice, not having competent advice in place makes a difficult situation worse, and can lead to prosecution or fines.

How much time does this actually take from my business?
Very little. Most of the work happens in the background, reviews, advice, and check-ins fit around your business, not the other way round. You get a named point of contact without needing to manage anything day-to-day.

Does this replace my need for other services like RAMS or audits?
